Costs of enforcement proceedings involving enforcement of real estate – selected issues

The issue of legal costs is strongly linked to the idea of access to court enforcement, which is the last stage of civil litigation. Judicial enforcement plays an important role in the field of law enforcement, but it does not meet the legislative activity with due regard, including the costs of enforcement proceedings. The comments do not cover the cost issues related to real estate execution in a comprehensive way, but they allow us to reflect on the many issues that still require legislative intervention. The doubts that have arisen over the years of applying cost norms, also appearing in court case law, should seem to provoke the legislator to act. Unfortunately, the amendments do not bring the expected solutions. In addition, as noted in the doctrine of statutory changes in enforcement costs, they are usually separated from the economic, social and procedural issues that remain with them.
