Abstract

Analyzed Article 6 of the Act on the National Medical Rescue provides a rescuer with a guarantee of repairing the damage suffered while rescuing an accidental person. The article shows that this provision narrows the problem of the State Treasury responsibility only to damage to property and to repair the actual loss suffered by the person who provided help without due regard to personal injury and lost profits, i.e. without providing a full compensation. It was also indicated that the reference in Article 6 par. 4 of the Act on the National Medical Rescue means the application in particular of the Articles 361–363 of the Civil Code, i.e. regarding the causual link, the issue of the injured party’s contribution to the damage and the method of repairing the damage. In addition, the issue of joint and several liability and the matter of limitation of the claim, which were not provided for in the Act on the National Medical Rescue, were presented.
