Abstract

In the era of progressive digitization, which enters new areas of people’s lives, there is the problem of current legal regulations in relation to the use of new solutions offered by the Internet. New technologies make people transfer a large part of their lives to cyberspace, which in turn leads to the creation of numerous digital content. Polish regulations do not explicitly regulate the issue of inheritance of digital data. To gain access to them after the death of a loved one, it is necessary to prove their property nature and that they come from a civil law relationship, and that they are not of a personal nature to the testator, which is very difficult in the case of digital data of natural persons. This article will attempt to clarify issues related to the issue of inheritance of digital content based on applicable inheritance law in the Polish legal system.
