„The Customary Manner” – the Role and Importance of Providing Information on Local Law for the Local Community

Abstract

Providing with the information concerning the law in a traditional for this area way is a term which frequently appears in the legal acts being in force. Basically, this method of giving out the information is intended to guarantee the implementation of the principle of the publicity of the local law. However, does the formulation introduce a clear designation for the indicated term? This article takes up an attempt to answer this question. The aim of this study is to present historical and current law regulations which are related to the habitual way of informing about the local law. As a part of the essay, the analysis of selected laws which refer to the traditional way of informing about the local acts was made. It took into consideration three aspects of the implementation of the principle of law publicity, i.e. creation and obligation of the local law, as well as increasing the level of legal awareness among its recipients. Moreover, the idea of appropriate authority’s competence within the local government to determine the customary way of providing with information about the law locally in force has been touched upon. There have also been presented some proposals to use new flow channels of the information on the local law to the residents of the community, given as the examples of good practice in this field.
