Abstract

The law establishing the State Commission for Combating the Sexual Exploitation of Minors under the age of 15 has implemented a range of measures aimed at safeguarding against offenses concerning the sexual freedom and morality of minors. The Commission’s particular significance is evident in relation to Article 240 of the Penal Code, which pertains to the criminal liability for not reporting certain crimes. This article discusses the importance of the Commission in relation to prosecuting offenders under Article 240 of the Penal Code, its competencies, its impact on conducting criminal proceedings in this matter, as well as positions concerning the interpretation of provisions after July 13, 2019.
