Abstract

Energy security and the need to diversify supplies are currently recurring topics in both literature and politics, but before any action is taken, it is necessary to answer the question of how far-reaching interference in the commercial transaction of energy companies is acceptable in order to ensure energy security and whether current instruments granted to the President of the Energy Regulatory Office are sufficient to provide it. It should be remembered that every interference in the economic turnover is subject to detailed assessment both by the Polish judiciary and EU entities. This article is an attempt to answer the above questions in the context of jurisprudence and broadly understood literature.
