Abstract

The topic of the article are the procedures and obligations to be met by the entrepreneurs in Poland, who want to hire the foreigners in their company. Foreigners are divided into citizens of the European Union and those from outside the European Union. In the context of employment outside of citizenship, it is important to the legal situation of the foreigner, because the legislature thus protecting the domestic labor market, among others, by introducing a foreign restrictions on access to that market. Legal employment of a foreigner requires a specific behavior rules of procedure, which is determined primarily by applicable act on foreigners. The article presents the current barriers and difficulties faced by employers, who employ foreigners, as well as the obligations that lie on them. Basic issues that should be pointed out are the procedure for obtaining a work permit in Poland and exceptions to this rule. Article summary constitute conclusions de lege ferenda in the context of procedures for the employment of foreigners in Poland. This topic is particularly relevant in the wave of migration era, which consists mainly of foreigners coming from outside the European Union Member States.
