Abstract

On 1 July 2013, the "big" amendment to the Code of Criminal Procedure of 27 September 2013 entered into force, amending, among others, the model of preliminary proceedings. While maintaining the investigation and the enquiry, it weakened the preliminary proceedings to provide more contradictoriness to the court proceedings. It also changed the rules of preservation of evidence and methods of exercise of the proceedings. The changes were criticised, the consequence of which was a return to the essential solutions applicable until 30 June 2015, this under another amendment to the Code of Criminal Procedure of 11 March 2016. Such rapid and essential changes raise concerns and practical problems.
