Abstract

The victim of a crime is one of the important participants of a criminal process. Penal mediation is created to assure larger comfort to the affected by the crime in executing their claims in the criminal proceedings. The agreement reached during mediation influences the situation of the victim and the accused. Spacious changes in the Code of Criminal Proceedings pay attention to the principles of mediatory conduct, the role of the judicial assistant in the criminal process, as well as the guarantees of the rights of the accused. The author makes preliminary reflections on the essential problems of the victim’s rights in the mediatory conduct, which can be developed in further scientific studies.
