Abstract

Awareness of the need for the enactment of a new Constitution in Poland was born before 1989. The entry into force of the Constitution of the Republic of Poland in 1997 should be considered a victory of positivism in understanding of law. This Act introduced a lot of new institutions and regulations into the Polish legal system and sanctioned the changes in Poland after 1989. The Constitution of 1997 made undeniably a breakthrough in the area of lawmaking principles. Regulation concerning the sources of law radically broke up with the earlier legal order and insofar lawmaking practice by introducing a closed system of the sources of law. However, a classical delegated legislation was not implemented.
