Abstract

The aim of the paper is to present the responsibilities of the Head of State in regard to the supreme authority over the Armed Forces and state security in the constitutional makeshift of the People’s Poland in the years 1944-1952. The Author makes an attempt to review the activities of the President of the State National Council and the President of the Republic of Poland as a Commander-in-Chief of the Armed Forces. The article includes dogmatic analysis of the supreme control being its subject and its identity with the practical application of the legal provisions. The conducted analysis allows to formulate a conclusion, that granting the President a title of the Commander-in-Chief of the Armed Forces in the Constitution of March was one of many components of illusory formal and legal activities which intended to indicate systemic continuity.
