A few comments on the right to refuse to testify

The subject of this study is the issue of the witness's right to refuse to testify in Roman law and the listing of this institution with the applicable criminal procedural regulations, i.e. art. 182, 183 and 185 k.p.k. Attention was drawn to the criteria which decide about the possibility of using the right to refuse to testify and who is entitled to it. In the context of the current Code of Criminal Procedure, the effects of the witness's refusal to testify were also indicated. The article attempts to show that the right to refuse to testify has its origin in Roman law.
