Abstract

This publication is a commentary on the ruling of the Supreme Court issued in connection with a cassation appeal filed by the Commissioner for Citizens' Rights, as a result of a suspected gross violation of applicable legal regulations. Gloss raises complex problems related to the perpetrators of prohibited acts, whose ability to recognize their meaning or direct the proceedings raises doubts due to the state of mental health. The commentary shows the controversy connected with the prescriptive procedure known in the criminal procedure in relation to perpetrators experiencing mental disorders.
