Abstract

This article pertains to theso-called consensual verdictin the Polish criminal procedure (art.335, 387 and 23a). It focuses the modification of that institutions caused by changes in the law. The text concerns the compliance of plea bargaining with the fair trail requirements in the spectrum of such statutory fair trail guarantees as the nemo tenetur principle, the right to defense and the principles of objective truth.The author analysis mainly if art.335, 387 and 23a Polish Code of the Criminal Procedure require self-accusation and require that the suspect must make a guilty plea.
