Agreement for a project carried out by a special purpose vehicle in the act on public-private partnership. Outline of the legal characteristics with elements of statistical effectiveness in the years 2016–2020

Abstract

In the study, I present the contract characteristics of the project carried out by the special purpose vehicle in the Act on public-private partnership, along with elements of statistical effectiveness in this regard. I point out that the nature of the partnership agreement has the features of an unnamed agreement of a civil law nature, and the purpose of the SPV is aimed at one-off implementation of the agreed purpose of the parties’ activities with the possibility of further operation in the future. Moreover, I point out that, taking into account the statistical data for 2016–2020, the issue of the effectiveness of the contract for the project carried out by the special purpose vehicle in the Act on public-private partnership is still an assessment issue.
