Abstract

This article evaluates the provisions of the pharmacy for a pharmacist in the context of the principle of economic activity freedom, and analyzes the demographic-geographical premises conditioning granting a license to operate a pharmacy, with regard to an equal access of patients to pharmaceutical services. The article presents the nature, definition and the form of permission to operate a pharmacy. In the further part of the paper, the principle of economic activity freedom and the possibility of limiting it regarding the provisions of the “pharmacy for a pharmacist” act were discussed and analyzed. The article also contains an analysis and assessment of subjective and demographic-geographical limitations regarding the permission to operate a pharmacy. In the summary, it was noted that the criteria of patients’ important and necessary interest in being provided with access to medicinal products, allowing the health minister to consent to grant through the voivodship pharmaceutical inspector a permit to operate a generally accessible pharmacy excluding demographic- geographical limitations, are too general and require detailing by the legislator.
