Counteracting SLAPP lawsuits – selected topics

Abstract

In April 2024, the European Parliament and the Council adopted the Directive on protecting persons who engage in public participation from manifestly unfounded claims or abusive court proceedings („Strategic lawsuits against public participation”).The Directive must be transposed into national law by 7 May 2026. The article is dedicated to the issue of SLAPP lawsuits addressed by the directive, and its main objective is to determine whether a separate regulation for such lawsuits is needed in Polish civil proceedings.
