DOES A WITNESS-EXPERT ACCELERATES A SIMPLIFIED PROCEEDINGS?

A witness-expert institution was introduced to a simplified proceedings under the amendment to the Code of Civil Procedure of 4 July 2019. The author argues that the witness-expert institution is a remedy to reconcile the need to reach the expert’s opinion and guarantee the speed and effectiveness of the simplified proceedings. Despite the fact that the witness-expert institution accelerates the simplified proceedings, it can, in practice, stall them, since the opposing party should be given the opportunity to question the opinion so as not to breach the principle of equality of arms and the right to a fair trail.
