SUMMARY OF PROBLEMS RELATED TO THE INTERPRETATION OF THE TERM “SIGNIFICANT NUMBER” UNDER THE ACT ON COUNTERACTING DRUG ADDICTION

Abstract

The text attempts to establish if existing case-law and opinions expressed in the legal literature allow to determine conclusive method of interpretation of the term “significant number” under the Act on Counteracting Drug Addiction. For that purpose, different opinions were analyse, compered and evaluate in accordance with textual, schematic and teleological interpretation. The article indicates that currently there is only one dominant model of interpretation of the term “significant number” and there are no legal basis to increase limit values based on quality and quantity of prohibited substances or take account of other criteria.
