Abstract

The subject of the article is the effectiveness of the furiosus declaration of will and the contemporary approach to this legal institution of civil and administrative courts. The aim of the article is to compare the contemporary understanding of the term furiosus with its understanding resulting from the works of Roman jurists. The article also shows the connection between the institutions of modern civil law and Roman legal culture. The basic conclusion, resulting from the scope of the article's content, is a wider range of meaning of the term furiosus used in modern jurisprudence in comparison with the understanding of this institution in Roman law.
