Abstract

The text is a polemic in relation to the previous publication and concerns the problem of waiver of attorney-client privilege in the Polish criminal trial. The theoretical assumptions concerning advocate's secrecy are presented, its material and subjective scope is indicated, as well as the institution of waiving this secrecy for procedural use under Article 180 § 2 of the Code of Criminal Procedure. Measures for the protection of attorney-client privilege in the criminal trial are discussed
