Abstract

The subject of this study are selected specific issues regarding the impact of substantive family law on the Mortgage and Land Register proceeding. The analysis of selected practical problems of the Mortgage and Land Register proceeding related to real estate trading will enable an attempt to present proposals for their resolution. Initially, the issue of the statutory property regime of spouses will be presented in the context of the Division II of the Mortgage and Land Register. Subsequently, the issue of the circle of participants in the Mortgage and Land Register proceeding covering the joint property of the spouses will be subject to assessment. Finally, the nature of the permission of the guardianship court granted to parents to carry out activities beyond the scope of ordinary management in the Mortgage and Land Register practice will be discussed.
