Evidence from documents in the order for payment proceedings in the context of the documentary form of legal actions

Abstract

The article concerns the issue of the impact of introducing a legal definition of a document in the art. 773 of the Civil Code and amendments in the form of legal actions on the evidentiary situation in the order for payment proceedings. The author analysing the amendments in the Civil Code and the Code of Civil Procedure, which entered into force on 8 September 2016, examines whether the procedural situation of plaintiffs requesting for hearing their cases in order for payment proceedings and the possibility to obtain an order for payment in this special proceedings have changed.
