Abstract

The main aim of this articleis to try to present the child’s legal position under Chinese private law. At the outset it was presented the registration system for the birth of Chinese children and it was made reference to the policy of one child and the policy of two children. Then, it was presented the specificity of child protection under the Act – Marriage Law of 1989 taking into account regulations regarding the so-called xiao filial piety. Finally it was presented the institution of legal guardian ship provided by parents over the child according to General Rules of the Civil Law of the People’s Republic of China.
