Price is the dominant criterion in orders for the supply of medicinal products

The aim of this article was to present that sustainable competition, appropriate distribution of goods, and reliable management of public funds in the field of public procurement for medicinal products are disturbed due to the use of only the price criteria in the preparation of tenders for medicines, which results from many broadly described reasons. The main research method was the dogmatic-legal method, which involved examining the provisions of the key public procurement law and the related act on health care services.
The result of the analysis and the adopted methodology is the determination that the use by procurers of only the price criteria when formulating public procurement procedures for medicinal products is detrimental to the highest value of each system, which is human life and health, in this case patients, and takes into account only the economic factors of a specific medical facility.
