In the voted judgment, the opinion worthy of approval was adopted, according to which the fact that the balcony does not meet the individual needs of the owner of the apartment to which it adjoins, but “constitutes communication”, its function is to connect the staircase with the entrance to the apartment, is an important factor in determining whether the balcony it is a part of the shared property or an adjacent apartment.
