Abstract: The article analyzes and presents the concept of benefits received unduly in the area of social assistance under the acts on social assistance, on family benefits, on state assistance in raising children and on assistance to persons entitled to alimony to ensure social security in Poland. The premises were also indicated that distinguish unduly collected benefits from the commonly known undue benefits regulated in the Civil Code. The article also presents the judiciary's positions regarding benefits unduly collected in the context of each of the discussed acts.
