Abstract

This gloss discusses the controversy whether the term in contravention of the conditions of the authorisation used in Art. 116 of the Act of 4 February 1994 on copyright and related rights (Dz.U. 2000, No. 80, Item 904, as amended) refers only to the rights granted under the licence to distribute the work, and not also to obligations arising from the licence agreement (e.g. the right to remuneration or the obligation to present financial statements).
